A forty-eight-year-old Massachusetts man was riding his motorcycle in the southern Berkshires when an automobile turned onto the same lane immediately in front of him. To avoid a collision, the motorcyclist had to turn quickly, forcing him off of his motorcycle. Reportedly, the next thing the man remembered was waking up in the Berkshire Medical Center several hours later. The man had to be hospitalized for several months due to severe internal damage and ultimately had his spleen removed.
As a result of losing his spleen, the man was more susceptible to infection. The motorcyclist reportedly got a severe fungal infection in his heart, requiring months of treatment and monetarization. The man alleged that his infection was caused by the removal of his spleen which itself was caused by the negligent automobile driver. To recover for his injuries, the man’s attorneys, Mark Herlihy and Karen Thursby, filed a personal injury lawsuit. To compensate him for his pain and suffering, medical expenses, and future expenses, the man eventually received $1.9 million dollars.
