Massachusetts Motorcyclist Awarded Nearly $2 Million in Personal Injury Damages After Collision.

A forty-eight-year-old Massachusetts man was riding his motorcycle in the southern Berkshires when an automobile turned onto the same lane immediately in front of him.  To avoid a collision, the motorcyclist had to turn quickly, forcing him off of his motorcycle.  Reportedly, the next thing the man remembered was waking up in the Berkshire Medical Center several hours later.  The man had to be hospitalized for several months due to severe internal damage and ultimately had his spleen removed.

As a result of losing his spleen, the man was more susceptible to infection.  The motorcyclist reportedly got a severe fungal infection in his heart, requiring months of treatment and monetarization.  The man alleged that his infection was caused by the removal of his spleen which itself was caused by the negligent automobile driver.  To recover for his injuries, the man’s attorneys, Mark Herlihy and Karen Thursby, filed a personal injury lawsuit.  To compensate him for his pain and suffering, medical expenses, and future expenses, the man eventually received $1.9 million dollars.

Despite being able to travel at the high speeds of a car, motorcycles offer none of the same protections, which is perhaps why motorcyclists make up a disproportionately large percentage of all of the serious injuries on the roads in Massachusetts and throughout the developed world. There is a wonderful sense of freedom that comes with riding a motorcycle: the roar of the engine between your legs, the wind rushing past you, and the rush of adrenaline are examples.  This freedom does not come without its elements of risk, however, and many motorcyclists forget how just exposed they are to injury while traveling on our roads and highways.

If you have been injured due to a negligent driver while riding your motorcycle, you may be entitled to money damages for your injuries. There is generally a three-year statute of limitations that restricts the amount of time that an injured Massachusetts motorcycle accident victim has to settle a claim or file a lawsuit.
